NERIC has developed documentation forms for collectors and recyclers for operations under the new Minnesota electronics recycling law following input and concurrence by several manufacturers, collectors, recyclers and the Minnesota Pollution Control Agency (MPCA). These forms are designed for use by all collectors and recyclers interesting in participating in the new Minnesota system and are a step towards ensuring the integrity of "service pounds" of recycled covered electronic devices acquired by manufacturers for compliance with new state requirements.
As required in the law, manufacturers must perform "due diligence" on the recyclers with which they work. Specifically, manufacturers "must conduct and document due diligence assessments of collectors and recyclers it contracts with, including an assessment of items specified under subdivision 2." The requirements of subdivision 2 include certifying that (b), that facilities that recycle video display devices, including all downstream recycling operations: (1) comply with all applicable health, environmental, safety, and financial responsibility regulations; (2) are licensed by all applicable governmental authorities; (3) use no prison labor to recycle video display devices; and (4) possess liability insurance of not less than $1,000,000 for environmental releases, accidents, and other emergencies.
The NCER has developed a prototype approach to due diligence as guidance to manufacturers for conducting the required Minnesota due diligence.
